Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Wayne County Court, rendered October 3, 2008, and for other relief,

Now, upon reading and filing the affidavit of Ohnja Olomonsa sworn to December 1, 2014, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed.

Memorandum: The appeal taken from the judgment of Wayne County Court rendered October 3, 2008 for indictment 08-59 was decided by the order of this Court entered March 19, 2010. By order dated August 14, 2014, Justice John V. Centra denied the motion of defendant seeking permission to appeal an order of Wayne County Court dated July 11, 2013.
