On order of the Court, the application for leave to appeal from the February 26, 2002 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration as on leave granted. See Arizona v Youngblood, 488 U.S. 51; 109 S.Ct. 333; 102 L.Ed.2d 281 (1988); People v Sobczak-Obetts, 463 Mich. 687; 625 N.W.2d 764 (2001). The Court of Appeals is to assign the matter to the same panel assigned to hear People v. Richardson, COA No. 239386.

Cavanagh and Kelly, JJ., would deny leave to appeal.
