Application by the appellant for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated October 4, 2004 ( People v Rhodes, 11 AD3d 487), affirming a judgment of the Supreme Court, Queens County, rendered December 4, 2000.

Before: Schmidt, J.P., Santucci, Luciano and Skelos, JJ., concur.


Ordered that the application is denied.

The appellant has failed to establish that he was denied the effective assistance of appellate counsel ( see Jones v Barnes, 463 US 745; People v Stultz, 2 NY3d 277).
