Opinion
February 29, 1972
Appeal from the Suffolk County District Court, ROCKWELL D. COLANERI, J.
George J. Aspland, District Attorney ( Ronald E. Lipetz of counsel), for appellant.
Sarisohn, Thierman Sarisohn ( Walter G. Steindler of counsel), for respondent.
Order unanimously reversed on the law and motion to suppress evidence remanded for determination de novo after a new hearing.
In our opinion, the doctrine of collateral estoppel is inapplicable (see United States v. Wallace Co., 336 U.S. 793; United States v. Williams, 227 F.2d 149). The interests of justice will be served by ordering a new hearing on the original motion to suppress.
