Opinion

THE PEOPLE, Plaintiff and Respondent, v. KEVIN DWAYNE NORMAN, Defendant and Appellant.

California Appellate Project, Jonathan B. Steiner, Executive Director, and Kathleen Caverly, Staff Attorney, for Defendant and Appellant. No appearance for Plaintiff and Respondent.

INTRODUCTION

Defendant Kevin Dwayne Norman appeals from a judgment of conviction entered after a jury found him guilty of attempted burglary of a vehicle (Pen. Code, §§ 459, 664) and he admitted one prior conviction (id., §§ 667, subds. (b)-(i), 1170.12). Following his conviction, the trial court sentenced him to state prison for a term of three years. We affirm the judgment with directions to correct an error in the abstract of judgment.

DISCUSSION

Counsel for defendant filed a brief in which no issues were raised, requesting independent review by this court pursuant to People v. Wende (1979) 25 Cal.3d 436. On August 15, 2003, we advised defendant that he had 30 days within which to submit personally any contentions or issues which he wished us to consider. To date, we have received no response from him.

We have conducted an independent review of the record in this case. (People v. Wende, supra, 25 Cal.3d at p. 441.) We find no reversible error. We note, however, that the abstract of judgment erroneously indicates that defendant was convicted by plea rather than by jury. This error should be corrected.

The judgment is affirmed. The clerk of the court is directed to correct the abstract of judgment to show a conviction by jury and to forward a copy of the corrected abstract of judgment to the Department of Corrections.

We concur: ORTEGA, J. and VOGEL (MIRIAM A.), J.
