THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. MARCUS A. NORMAN, DEFENDANT-APPELLANT.


PRESENT:

Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Chautauqua County Court, rendered September 29, 2016,

Now, upon reading and filing the affidavit of Marcus A. Norman sworn to January 16, 2017, the notice of motion with proof of service thereof, the affirmation of Andrew M. Molitor, Esq. dated February 7, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal dated October 31, 2016, which was filed at the Chautauqua County Clerk's Office on November 1, 2016 and served on the Chautauqua County District Attorney on November 1, 2016 is hereby deemed timely filed and served.
