People v. Nieves

Appellate Division of the Supreme Court of New York, First Department
Oct 21, 2003
309 A.D.2d 619 (N.Y. App. Div. 2003)

Opinion

1896.

October 21, 2003.

Judgment, Supreme Court, New York County (Renee White, J.), rendered July 11, 2000, convicting defendant, upon his plea of guilty, of attempted assault in the second degree, and sentencing him to a term of 1 year, unanimously affirmed.

Christopher Wilson, for respondent.

Judith Stern, for defendant-appellant.

Before: Tom, J.P., Saxe, Rosenberger, Marlow, JJ.

Given the seriousness of the crime and the attendant circumstances, we perceive no basis for granting defendant youthful offender treatment ( see People v. Drayton, 39 N.Y.2d 580, 584).

THIS CONSTITUTES THE DECISION AND ORDER OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
