People v. Nelson

Appellate Division of the Supreme Court of New York, Fourth Department
Feb 25, 1977
56 A.D.2d 736 (N.Y. App. Div. 1977)

Opinion

February 25, 1977

Appeal from the Monroe County Court.

Present — Moule, J.P., Cardamone, Simons, Dillon and Witmer, JJ.

Judgment unanimously affirmed. Memorandum: Although the trial court at sentencing improperly stated that anyone "convicted of a violent crime can only expect to receive the maximum", the sentence imposed is not excessive in view of the vicious nature of defendant's conduct and his history of criminal activity.
