Opinion
May 15, 1967
Judgment of the County Court, Nassau County, rendered September 25, 1964, convicting defendant of nine counts of feloniously selling a narcotic drug, upon a jury verdict, and sentencing him to 7 to 15 years on each count, to be served consecutively, modified, on the law and the facts, to the extent that the sentences on all the counts shall run concurrently. As so modified, judgment affirmed. In our opinion, the cumulative sentences of 63 to 135 years, resulting from the imposition of 9 consecutive sentences of 7 to 15 years, were excessive on this record, and the sentences as herein modified are fair and reasonable. Ughetta, Acting P.J., Christ, Brennan, Benjamin and Munder, JJ., concur.
