People v. Mydosh

Appellate Division of the Supreme Court of New York, Second Department
Mar 14, 2006
27 A.D.3d 580 (N.Y. App. Div. 2006)

Opinion

2005-00679.

March 14, 2006.

Appeal by the defendant from a judgment of the County Court, Orange County (Berry, J.), rendered December 13, 2004, convicting her of petit larceny, upon her plea of guilty, and imposing sentence.

Ferrara Sullivan, Monticello, N.Y. (John Ferrara of counsel), for appellant.

Francis D. Phillips II, District Attorney, Goshen, N.Y. (David R. Huey of counsel), for respondent.

Before: Adams, J.P., Ritter, Goldstein, Skelos and Dillon, JJ., concur.

Ordered that the judgment is affirmed.

The defendant's waiver of her right to appeal was valid and precludes review of her challenge to the factual sufficiency of her plea allocution ( see People v. Curras, 1 AD3d 445, 446; People v. Green, 200 AD2d 687).
