By order of February 29, 2000 the delayed application for leave to appeal from the June 28, 1999 decision of the Court of Appeals was held in abeyance pending the decision in People v Bulger, (Docket No. 112694).

On order of the Court, the decision having been issued on July 18, 2000, 462 Mich. 495 (2000), the delayed application is again considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh, J., would grant leave to appeal to reconsider this Court's strained reasoning in People v Bulger and save this defendant a trip to federal court for relief.
