Opinion

B167599.

11-24-2003

THE PEOPLE, Plaintiff and Respondent, v. VICTOR MURPHY, Defendant and Appellant.

Mary Ann Foster, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.

Victor Murphy appeals an order determining him to be a mentally disordered offender pursuant to Penal Code section 2962 et seq., and committing him to the Department of Mental Health for treatment.

We appointed counsel to represent Murphy in this appeal. After counsels examination of the record, she filed an opening brief raising no issues.

On October 9, 2003, we advised Murphy that he had 30 days within which to personally submit any contentions or issues that he wished to raise on appeal. We have received no response from him.

We have reviewed the entire record and are satisfied that Murphys attorney has fully complied with her responsibilities and that no arguable issues exist. (People v. Wende (1979) 25 Cal.3d 436, 441.)

The order is affirmed.

We concur: COFFEE, J., PERREN, J.
