An order of this Court having been entered on February 13, 2020 (M-8678) continuing defendant's previously granted leave to prosecute, as a poor person, the appeal taken to this Court from the judgment of the Supreme Court, New York County, rendered on or about June 24, 2016, and substituting Steven Wershaw, Esq., as counsel to prosecute the appeal, And defendant-appellant having moved to relieve Steven Wershaw, Esq. as assigned counsel; to continue the previously granted poor person relief to the limited extent of providing retained counsel Richard E. Mischel, Esq. with the transcripts of the proceedings previously provided to Steven Wershaw, Esq.; and to substitute assigned counsel with retained counsel, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted to the extent of relieving Steven Wershaw, Esq., as assigned counsel and continuing the previously granted poor person relief to the limited extent of providing Richard E. Mischel, Esq. copies of the transcripts of the proceedings. That branch of defendant's motion seeking the substitution of counsel is denied as unnecessary. It is further ordered that defendant's time in which to perfect the appeal is extended until 120 days from the date of this order or the receipt of the complete record, whichever is later.
