DECISION & ORDER ON MOTION

Motion by Alan I. Stutman, counsel assigned to represent the respondent in the Supreme Court, Kings County, in effect, to be relieved of the assignment to respond to an appeal by the People from an order of the Supreme Court, Kings County, dated November 14, 2012.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, and Alan I. Stutman, Esq., 50 Court Street, Suite 501, Brooklyn, N.Y. 11201, is directed to turn over all papers in the action to new counsel herein assigned; and it is further,

ORDERED that pursuant to County Law § 722 the following named attorney is assigned as counsel to respond to the appeal:
