Petitioner's delayed application for leave to appeal to the Michigan Supreme Court was also denied for failure to meet the burden of establishing entitlement to relief under M.C.R. 6.508(D). Thereafter, Petitioner filed the pending petition for a writ of habeas corpus presenting the same five claims presented in application for leave to appeal to the Michigan Supreme Court and in his motion for relief from judgment.
