Opinion

THE PEOPLE, Plaintiff and Respondent, v. RAZMIK MOVSESYAN, Defendant and Appellant. B193215 California Court of Appeal, Second District, Sixth Division November 29, 2007

NOT TO BE PUBLISHED IN THE OFFICIAL REPORTS

Superior Court County of Los Angeles No. BA278662 William L. Evans, Judge

Jeffrey Lewis, under appointment by the Court of Appeal, for Defendant and Appellant.

No appearance for Plaintiff and Respondent.

COFFEE, J.

Appellant Razmik Movsesyan appeals a judgment entered following his conviction by jury of first degree residential burglary. (Pen. Code, §§ 459, 460, subd. (a).) The court found true the allegation that he had suffered a prior conviction within the meaning of the Three Strikes law. (§§ 667, subd. (b)-(i), 1170.12.) Appellant was sentenced to 9 years in state prison, consisting of the lower term of 2 years doubled to 4 years, plus 5 years for the prior conviction allegation. (§ 667 subd. (a)(1).)

Appellant and a co-defendant shattered a kitchen window and entered the home of a superior court judge. Once inside, they ripped from the wall an alarm control box, speaker and motion sensor. They removed a VCR, DVD player, CDs and a telephone answering machine. Appellant and his co-defendant also took a laptop computer. It had a decal on it that read "Superior Court" and another decal with the judge's name. The computer had pictures of the judge on a recent vacation.

The victim drove into her driveway, surprising the defendants. They fled from the house and dumped the answering machine and DVD player near a trash can. The victim called 911 from her cell phone. While speaking to the operator, she saw two men walk quickly behind her car, enter a parked car and drive away. She reported the license number. Police officers traced the car and found it was registered to appellant's co-defendant. They found a VCR and CD's from the trunk. The laptop had been sold, but was later recovered.

Appellant was arrested and interviewed by a police detective. He told the detective that he entered the house with a co-defendant and they broke the alarm system. They took some things from the house, including a laptop computer, and fled out the back door where they dropped some things into a trash can. They kept the laptop and CD's, got into the car and drove away. Appellant indicated he knew the laptop belonged to a judge and that it had pictures of her on a trip. The detective prepared a statement which appellant read and signed.

We appointed counsel to represent appellant in this appeal. After reviewing the record, counsel filed an opening brief raising no issues and requesting this court to independently examine the record pursuant to People v. Wende (1979) 25 Cal.3d 436.

On March 16, 2007, we advised appellant that he had 30 days in which to submit a written brief or letter stating any contentions or arguments he wished us to consider. On March 29, 2007, we received a letter from him requesting a 60-day extension. On April 9, 2007, we received a letter from appellant's counsel with the same request. We granted an extension until May 16, 2007.

On May 3, 2007, appellant requested a second extension, indicating that he was attempting to obtain a copy of his confession, which was necessary to prepare a supplemental brief. We granted an extension to July 30, 2007. We have had no further response from him.

We have examined the entire record and are satisfied that appellant's attorney has fully complied with his responsibilities and that no arguable issues exist. (People v. Wende, supra, 25 Cal.3d at p. 441.)

The judgment is affirmed.

We concur: GILBERT, P.J., PERREN, J.
