An appeal having been taken from a judgment of the Supreme Court, New York County, rendered on or about October 31, 2019,
And an order of this Court having been entered on January 7, 2020 (M-8525) granting defendant poor person relief and assigning Janet E. Sabel, Esq., The Legal Aid Society, as counsel to prosecute the appeal from the aforesaid judgment under Case No. 2019-05229, And an order of this Court having been entered on March 5, 2020 (M-373) granting defendant poor person relief and assigning Christina Swarns, Esq., predecessor to Caprice R. Jenerson, Esq., Office of the Appellate Defender, as counsel to prosecute the appeal from the aforesaid judgment under Case No. 2020-00494, And a Certificate by a Justice of this Court having been entered on August 5, 2021 granting defendant leave to appeal from the order, Supreme Court, New York County, entered on or about March 25, 2021, under Case No. 2019-05229, Now, on the Court's own motion, It is ordered that the order of this Court entered on January 7, 2020 (M-8525) granting defendant poor person relief and assigning Janet E. Sabel, Esq., The Legal Aid Society, as counsel to prosecute the appeal from the aforesaid judgment under Case No. 2019-05229, is hereby recalled and vacated, and the designation of Janet E. Sabel, Esq., The Legal Aid Society, as counsel to prosecute the appeal from the aforesaid judgment, is stricken. The order of this Court, entered on March 5, 2020 (M-373) granting defendant poor person relief and assigning Christina Swarns, Esq., predecessor to Caprice R. Jenerson, Esq., Office of the Appellate Defender, as counsel to prosecute the appeal from the aforesaid judgment, shall remain extant, and Caprice R. Jenerson, Esq., the Office of the Appellant Defender is assigned as counsel to prosecute the appeals from both the aforesaid judgment and order.
