People v. Mosley

Appellate Division of the Supreme Court of New York, Second Department
Nov 5, 2008
56 A.D.3d 493 (N.Y. App. Div. 2008)

Opinion

No. 2007-04285.

November 5, 2008.

Appeal by the defendant from a judgment of the County Court, Westchester County (Molea, J.), rendered April 10, 2007, convicting him of manslaughter in the first degree, upon his plea of guilty, and imposing sentence.

Mitchell J. Baker, White Plains, N.Y., for appellant.

Janet DiFiore, District Attorney, White Plains, N.Y. (Lois Cullen Valerio and Anthony J. Servino of counsel; Lauren Epstein on the brief), for respondent.

Fisher, J.P., Lifson, Covello and Balkin, JJ.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, Al NY2d 606 [1979]).
