Appellant having moved for a writ of error coram nobis vacating the order of this Court entered May 3, 2002 modifying a judgment of Herkimer County Court, rendered March 14, 2000,

Now, upon reading and filing the affidavits of David Mosca sworn to February 6, 2013, and April 30, 2013, the notice of motion with proof of service thereof, the affirmation of Robert R. Calli, Jr, Esq. dated April 15, 2013, and due deliberation having been had thereon,
