Defendant having moved for an order denying the request of respondent for an extension of time to file and serve a reply with respect to defendant's motion for a error coram nobis,

Now, upon reading and filing the affidavit of David Anthony Mosca sworn to April 2, 2013, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as moot.
