Judgment of conviction of the Court of Special Sessions of the City of New York, Borough of Richmond, reversed on the law and the facts and a new trial ordered. The criminal intent of the defendant was not proved beyond a reasonable doubt. Hagarty, Tompkins and Johnston, JJ., concur; Lazansky, P.J., and Davis, J., dissent and vote to affirm.
