People v. Morales

Appellate Division of the Supreme Court of New York, Second Department
Feb 14, 2006
26 A.D.3d 393 (N.Y. App. Div. 2006)

Opinion

2004-04303.

February 14, 2006.

Appeal by the defendant from a judgment of the County Court, Westchester County (DiBella, J.), rendered March 30, 2004, convicting him of robbery in the first degree (two counts) and attempted robbery in the second degree (two counts), upon his plea of guilty, and imposing sentence.

Ronnie James Ritz, Shrub Oak, N.Y., for appellant.

Janet DiFiore, District Attorney, White Plains, N.Y. (Valerie A. Livingston of counsel; Nicole C. Giordano on the brief), for respondent.

Before: Adams, J.P., Ritter, Goldstein, Skelos and Dillon, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).
