THE COURT:

It is ordered that the opinion filed herein on May 16, 2008 be modified as follows:

1. On page 8, the sixth sentence of the first full paragraph, the word "Mito" is changed to "Dustin" so the sentence reads:

Additionally, at one point, Dustin described the kiss as being like a good-night kiss.

There is no change in the judgment.
