Defendant having moved for permission to proceed as a poor person on the appeal taken from a judgment of the Monroe County Court, rendered January 20, 2012,

Now, upon reading and filing the affirmation of Donald M. Thompson, Esq. dated January 24, 2012, the notice of motion with proof of due service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon the filing and serving of an application seeking leave to appeal as a poor person that includes an affidavit from the parents of defendant demonstrating an inability to pay the cost, fees and expenses necessary to prosecute the appeal.
