DECISION & ORDER ON MOTION

Motion by the appellant pursuant to CPL 460.30 to enlarge his time to make a motion before this Court for leave to appeal to the Court of Appeals from a decision and order of this Court dated April 10, 2012, which determined an appeal from an order of the Supreme Court, Kings County, dated April 29, 2009.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion is denied as a motion for leave to appeal to the Court of Appeals was timely filed with the Court of Appeals.
