THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. MELVIN H. MILLER, DEFENDANT-APPELLANT.


PRESENT:

Respondent having moved for an extension of the time to file and serve a brief in response to the pro se supplemental brief on the appeal taken from a judgment of Wyoming County Court, rendered July 28, 2016,

Now, upon reading and filing the affidavit of Michael J. Flaherty, Jr., Esq. sworn to October 12, 2017, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and the Clerk of the Court is directed to accept the ten copies of the People's responding brief filed on October 6, 2017, and

It is further ORDERED that the time to file and serve a pro se reply brief is extended to November 14, 2017.
