As petitioner concedes, neither of the two claims urged in this proceeding were raised on direct appeal in the state courts. Both the Appellate Division, People v. Mildwoff, 49 A.D.2d 521, 373 N YS.2d 849 (1st Dep't 1975), and the New York Court of Appeals, People v. Mildwoff, 39 N.Y.2d 856, 386 N.Y.S.2d 214, 352 N.E.2d 131 (1976), affirmed petitioner's conviction. The claims raised and rejected on the state appeal concerned the legal sufficiency of the corroborative evidence of a forcible sex crime and the propriety of sentencing the defendant without a psychiatric report considering the bizarre nature of the crime.
