The issues to be briefed and argued are limited to the following: (1) Did the trial court have a duty to instruct sua sponte on an aiding and abetting theory of liability where defendant personally performed some elements of the charged offense and another person performed the remaining elements required to complete the crime? (2) If so, did the Court of Appeal correctly conclude that the trial court's failure to instruct on aiding and abetting was harmless error?
