Appellant having moved for reassignment of counsel on the appeal taken from a judgment of the Onondaga County Court, rendered October 9, 2009, and for other relief,

Now, upon reading and filing the affidavit of James P. Mhina sworn to September 26, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks reassignment of counsel is denied, and

It is further ORDERED that the motion insofar as it seeks permission to proceed pro se is denied without prejudice.
