People v. Mendelsohn

Court of Appeals of the State of New York
Feb 20, 1964
197 N.E.2d 630 (N.Y. 1964)

Opinion

Argued January 23, 1964

Decided February 20, 1964

Appeal from the Suffolk County Court, HERBERT W.J. HARGRAVE, J.P.

Murray Bogatin and Sidney R. Siben for appellant.

Bernard C. Smith, District Attorney ( Charles T. Matthews of counsel), for respondent.

Judgment affirmed. The question of the validity of that part of the ordinance of the Town of Islip regulating the procedure for the revocation of a license upon conviction for violation of its provisions does not arise on this appeal from the judgment of conviction and is therefore not reached or decided.

Concur: Chief Judge DESMOND and Judges DYE, FULD, VAN VOORHIS, BURKE, SCILEPPI and BERGAN.
