MODIFICATION OF OPINION

BLEASE, Acting P. J.

THE COURT:

The opinion of this court filed January 25, 2008, in the above entitled case is modified as follows:

1. On page 8, fifth line down in first full paragraph, add “eight months” after four years.

2. On page 8, fifth line down, substitute “principal” term in place of “total” term.

3. On page 8, eighth line down, substitute “one year” in place of “four months”.

4. On page 8, ninth line down, please omit footnote 8, causing renumbering of rest of the footnotes.

5. On page 14, third line down in the “DISPOSITION”, insert “eight months” after years.

6. On page 14, fifth line down, substitute “one year” in place of “four months”.

This modification does effect a change in the judgment.
