Judgment of a City Magistrate, holding a Court of Special Sessions of the City of New York, Borough of Queens, convicting the defendant of the crime of leaving the scene of an accident without reporting (Vehicle and Traffic Law, § 70, subd. 5-a), reversed on the law and the facts, the information dismissed, fine remitted, bail exonerated and the revocation of license vacated. It is admitted that appellant, who was the owner of the vehicle, was not operating it at the time of the accident. Nolan, P.J., Johnston, Adel, Wenzel and MacCrate, JJ., concur.
