ORDER

By order of October 3, 2023, the application for leave to appeal the May 18, 2023 judgment of the Court of Appeals was held in abeyance pending the decision in People v Butka (Docket No. 164598). On order of the Court, the case having been decided on July 22, 2024, ____Mich ___ (2024), the application is again considered and, pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we VACATE the judgment of the Court of Appeals and REMAND this case to that court for reconsideration in light of Butka.

We do not retain jurisdiction.

VIVIANO, J., would deny leave to appeal.
