MOTION DECISION

An order of this Court having been entered on May 30, 2017 (M-2315), inter alia, granting defendant's motion for leave to prosecute, as a poor person, the appeal from a judgment of the Supreme Court, New York County, rendered on or about March 13, 2017, and assigning Rosemary Herbert, Esq., as predecessor to Caprice R. Jenerson, Office of the Appellate Defender, as counsel to prosecute said appeal, And assigned counsel having moved for an order amending the aforementioned order of assignment to include the appeal from a modification of said judgment, rendered on or about October 28, 2022, under the same indictment number,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that said motion is granted to the extent of amending this Court's order of assignment, entered on May 30, 2017 (M-2315) to include the appeal taken under the same indictment number from the modified judgment rendered on or about October 28, 2022, and extending the poor person relief previously granted to cover same.
