Summary Dispositions December 22, 1998.

In lieu of granting leave to appeal, that portion of the October 14, 1998, order of the Court of Appeals that imposed costs on attorney Robert M. Morgan in the sum of $200 "for failing to ensure that a complete transcript was ordered within 28 days of the filing of the claim of appeal," is reversed. MCR 7.302(F)(1). Under the circumstances of this case, where the motion to extend time to order the transcript was unopposed and there is no apparent basis for finding of culpable neglect by the defendant's counsel, the Supreme Court is persuaded that the imposition of costs was an abuse of discretion, and the Court of Appeals is to remit the sum of $200 to attorney Robert M. Morgan if he already has paid the assessment. Jurisdiction is not retained. Court of Appeals No. 211354.
