Appellant having moved to extend the stay of sentence pending the appeal from the judgment of Seneca County Court, rendered March 28, 2011,

Now, upon reading and filing the affidavit of Mary J. Fahey, Esq. sworn to July 20, 2011, the notice of motion with proof of service thereof, the letter of Barry Porsch, Esq. dated July 22, 2011, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the stay granted by Justice Scudder is extended on the condition that the appeal is perfected on or before January 25, 2012.
