People v. Martinez

Appellate Division of the Supreme Court of New York, First Department
Apr 2, 1998
249 A.D.2d 15 (N.Y. App. Div. 1998)

Opinion

April 2, 1998

Appeal from Supreme Court, New York County (Renee White, J.).

The verdict was based on legally sufficient evidence and was not against the weight of the evidence. We see no reason to disturb the jury's determinations concerning credibility and reliability of the identification testimony (see, People v. Gaimari, 176 N.Y. 84, 94).

Concur — Sullivan, J.P., Rosenberger, Rubin and Tom, JJ.
