Appeal from the Supreme Court, Kings County (Rienzi, J.).


Ordered that the judgment is affirmed.

Viewing the evidence in the light most favorable to the prosecution, we find that it was legally sufficient to establish the defendant's guilt beyond a reasonable doubt (see, People v Contes, 60 N.Y.2d 620). Moreover, upon the exercise of our factual review power, we are satisfied that the verdict was not against the weight of the evidence (CPL 470.15). The record shows that the defendant failed to rebut the presumption of possession set forth in Penal Law § 220.25 (2), which, under the facts and circumstances of this case, clearly applied to him (see, People v Daniels, 37 N.Y.2d 624).

The defendant's remaining contentions are unpreserved for appellate review (CPL 470.05), and reversal of the judgment of conviction in the interest of justice is not warranted. Lawrence, J.P., Harwood, Balletta and Rosenblatt, JJ., concur.
