MODIFICATION ORDER AND ORDER DENYING PETITION FOR REHEARING

THE COURT:

It is ordered that the opinion filed herein on February 26, 2008 be modified as follows:

1. On page 8, second paragraph, the second sentence shall read:

Our review of the record convinces us that the trial court's refusal to place Defendants on probation and send them for drug treatment or strike a strike and its imposition of the presumptive midterm was based on their respective criminal histories and not the supplemental statement in aggravation.

The petition for rehearing is denied.

There is no change in the judgment
