Appellate Division of the Supreme Court of New York, Second Department
Nov 27, 2007
45 A.D.3d 869 (N.Y. App. Div. 2007)

Opinion

No. 2005-10690.

November 27, 2007.

Appeal by the defendant from a judgment of the Supreme Court, Kings County (Chun, J.), rendered November 1, 2005, convicting him of criminal sale of controlled substance in the third degree and criminal possession of a controlled substance in the seventh degree, upon his plea of guilty, and imposing sentence.

Lynn W. L. Fahey, New York, N.Y., for appellant.

Charles J. Hynes, District Attorney, Brooklyn, N.Y. (Leonard Joblove and Jodi L. Mandel of counsel), for respondent.

Before: Mastro, J.P., Santucci, Dillon and Angiolillo, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631 [1976]; cf. People v Gonzalez, 47 NY2d 606).
