MOTION DECISION

An order of this Court having been entered on August 24, 2023 (Motion No. 2023-02868) granting defendant leave to prosecute, as a poor person, the appeal taken to this Court from a judgment of the Supreme Court, New York County, rendered on or about April 13, 2023, and assigning Jenay Nurse Gilford, Esq., The Center for Appellate Litigation, as counsel to prosecute the appeal; and counsel purportedly retained by defendant having moved to reargue said motion, and, upon reargument, for an order designating counsel as appellate counsel, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, with leave to renew, upon proof of defendant's consent to substitute counsel.
