THE COURT

It is ordered that the opinion filed herein on September 27, 2007, be modified as follows:

1. On page 15, the subheading letter “D” is changed to subheading “C.”

2. On page 18, the subheading letter “E” is changed to subheading “D.”

3. On page 19, the subheading letter “F” is changed to subheading “E.”

4. On page 1, the publication order in footnote * is modified to read as follows: “Pursuant to California Rules of Court, rules 8.1105(b) and 8.110.1, this opinion is certified for publication with the exception of parts III.A-B, and D-E.”

Except for this modification, the opinion remains unchanged. This modification does not effect a change in judgment.
