It is ordered that the opinion filed herein on June 7, 2011, be modified as follows: On page 22, delete the fourth paragraph beginning “Furthermore, to the extent” and ending “trial demand to the district attorney” in its entirety. This modification does not effect a change in the judgment. The petition for rehearing is DENIED.
