It is ordered that defendant-appellant's motion is granted to the extent of dismissing the appeal because of the defendant-appellant's death on August 30, 2013, and remanding the matter to the Criminal Court of the City of New York, New York County, for proceedings to vacate the judgment of conviction and to dismiss the accusatory instrument.
