Defendant having moved pursuant to CPL 460.10(6) to extend the time to serve a notice of appeal from a judgment of Oswego County Court, rendered September 29, 2016,

Now, upon reading and filing the affidavit of Joseph G. Rodak, Esq. sworn to July 6, 2017, the affidavit of Yvonne W. Earl sworn to July 6, 2017, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted on the condition that Joseph G. Rodak, Esq. serves the notice of appeal on or before August 31, 2017.
