DECISION & ORDER ON APPLICATION

Application by defendant for a writ of error coram nobis seeking an extension of time to take an appeal from a judgment of conviction of the City Court of Beacon, Dutchess County, rendered July 19, 1995, and from an order of the same court dated December 19, 2014.

Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the application seeking an extension of time to take an appeal from a judgment of conviction of the City Court of Beacon, Dutchess County, rendered July 19, 1995, is granted (see People v Syville, 15 NY3d 391 [2010]); and it is further,

ORDERED that the papers submitted in support of the application are deemed to constitute a timely notice of appeal from that judgment of conviction; and it is further,

ORDERED that the appeal shall be perfected by December 1, 2017; and it is further,

ORDERED that the application is otherwise denied; and it is further,

ORDERED that defendant's counsel is directed to serve a copy of this decision and order upon the clerk of the court from which the appeal is taken.
