It is ordered that the opinion filed herein on September 22, 2006 (143 Cal.App.4th 247; __ Cal.Rptr.3d __), be modified as follows:

In the unpublished portion of the opinion, at pages 15 through 16, delete the text in section IIC and replace with the following:

Defendant argues that the trial court erred by sentencing him to mandatory consecutive terms pursuant to the Three Strikes law. (§ 667, subd. (c)(6).) Because defendant will not be resentenced pursuant to the Three Strikes law, we need not consider this contention.

This modification does not affect the judgment.

The petitions for rehearing are denied.
