ORDER

By order of July 5, 2024, the plaintiff-appellee was directed to answer the application for leave to appeal the May 10, 2024 order of the Court of Appeals. On order of the Court, the answer having been received, the application for leave to appeal is again considered. The motion for stay is GRANTED, and trial court proceedings in the Ottawa Circuit Court are stayed pending the completion of this appeal. We direct the Clerk to schedule oral argument on the application. MCR 7.305(H)(1). The parties shall file supplemental briefs in accordance with MCR 7.312(E), addressing: (1) whether People v Carpenter, 464 Mich. 223, 241 (2001) was correctly decided and, if not, (2) whether Carpenter should nonetheless be retained under principles of stare decisis, Coldwater v Consumers Energy Co, 500 Mich. 158, 172-174 (2017).

The Prosecuting Attorneys Association of Michigan and the Criminal Defense Attorneys of Michigan are invited to file briefs amicus curiae. Other persons or groups interested in the determination of the issues presented in this case may move the Court for permission to file briefs amicus curiae.
