The PEOPLE of the State of New York, Respondent, v. Miguel LUNA, Defendant–Appellant.


Defendant appeals from a judgment of the Criminal Court of the City of New York, New York County (Erika M. Edwards, J.), rendered January 29, 2013, convicting him, upon a plea of guilty, of disorderly conduct, and imposing sentence.
Present: SCHOENFELD, J.P., SHULMAN, LING–COHAN, JJ. PER CURIAM.

Judgment of conviction (Erika M. Edwards, J.), rendered January 29, 2013, reversed, on the law, accusatory instrument dismissed, and surcharge, if paid, remitted. ( See People v. Taylor, appeal numbered 12–215, decided herewith.)
