ORDER MODIFYING OPINION

[CHANGE IN JUDGMENT]

McKINSTER, Acting P.J.

In a “Letter of Modification” filed on November 2, 2007, attorney William J. Capriola has represented to us that “Appellant requests that the disposition be modified to state that the sentence on count 1 is stayed.”

Based on this request, the opinion filed in this matter on October 15, 2007 is hereby modified, as follows:

1. The second sentence in the first paragraph on page one is modified to read: “Affirmed as modified.”

2. The disposition on page 15 is modified to read “Sentence on Count 1 is stayed pursuant to section 654. In all other respects the judgment is affirmed.”

Except for this modification the opinion remains unchanged. This modification effects a change in the judgment.
